§ 1Scope
The legal entity named in the context of the reservation (hereinafter referred to as "sHome Hotel Graz") rents the agreed hotel room with the agreed facilities (hereinafter referred to as "hotel room") to the guest (hereinafter referred to as "guest") for the agreed duration of stay. These general terms and conditions and reservation conditions (hereinafter referred to as "GTC") apply to accommodation contracts for the rental of hotel rooms as well as all other services provided for the guest in the respective hotel.

§ 2Conclusion of contract
1.With the reservation of a hotel room, the guest sHome Hotel Graz offers the conclusion of an accommodation contract. If available, the guest will receive a reservation number from sHome Hotel Graz either by e-mail or fax, by telephone or in person, depending on the reservation variant (online / by e-mail, by phone or on site). The accommodation contract between sHome Hotel Graz and the guest comes into being when the guest receives the reservation number, when the guest pays the room rate or when the guest receives or transmits the access code (see § 4.1.) - depending on the situation what happens earlier.2.The guest is advised that reservation numbers that he receives from third parties (e.g. from online booking portals for hotel rooms) are not identical to the reservation number of sHome Hotel Graz. The guest can ask for the sHome Hotel Graz reservation number in the hotel.3.Offers from sHome Hotel Graz to conclude an accommodation contract are subject to change and non-binding. sHome Hotel Graz can refuse to conclude an accommodation contract with a guest at its own discretion.4.The guest has no right to the provision of a specific hotel room or to the fulfillment of special requests that go beyond the provision of a hotel room. He is only entitled to a hotel room of the room category he has booked.

§ 3Reservation, cancellation; Failure to use the hotel room
1.The following terms "simple reservation" and "guaranteed reservation" differ in that with the simple reservation the guest only orders a hotel room, while with the guaranteed reservation he also guarantees payment by providing his credit card details. The term "cancellation" below refers to the guest's withdrawal from the accommodation contract. Sections 2 to 7 explain the circumstances under which cancellation is possible free of charge and in which cases the overnight rate less saved expenses is still to be paid. The term "arrival day" below means the first day of the booking period. The following term "departure day" is the corresponding last day of the booking period.2.If the guest does not appear in the hotel by 7 p.m. for a simple reservation, the reservation expires without replacement and the reserved rooms go on sale. In this respect, the guest is no longer entitled to a hotel room.3.In the case of a guaranteed reservation, the reservation of the hotel room is maintained for the guest even after 6 p.m. The guest can cancel guaranteed reservations free of charge up to 6 p.m. on the day of arrival, unless the special conditions for group travel (see § 13) or the special conditions for trade fair and event times (see § 9) or reservations according to § 3.6 apply. have been made, which are marked as early bird rates or unless deviating conditions are specified in special offers from sHome Hotel Graz. In the event that the corresponding guaranteed reservations are canceled after 6 p.m. on the day of arrival, the guest remains obliged to pay the price for the first night. In this case, sHome Hotel Graz is free to rent the room to someone else.The same applies if the guest does not appear by 6 a.m. on the day following the day of arrival without having canceled his reservation by 6 p.m. on the day of arrival ("no-show"). Even then, the guest is obliged to pay the price for the first night. The guest is free to prove that the expenses saved by sHome Hotel Graz are higher.4.In the case of multi-day guaranteed reservations, if you do not show up by 6 a.m. on the day following the day of arrival, all nights following the night of the day of arrival (accordingly from the second night of the booking period) will be canceled. In this case, the guest is not entitled to a hotel room for the following nights. However, the guest is obliged to pay the price for the first night. The guest is free to prove that the expenses saved by sHome Hotel Graz are higher.5.The special conditions contained in § 8 and § 9 apply to group travel and reservations at trade fair and event times.6.Reservations at prices marked as early bird rates are binding and cannot be rebooked or canceled free of charge and can only be booked via the website www.shome-hotels.com. In these cases, the room rate or a corresponding deposit is payable directly upon reservation and is non-refundable. In the event of cancellation or no-show, no further amounts will be reimbursed to the guest. The guest is free to prove that the expenses saved by sHome Hotel Graz are higher.7.If the guest decides to pay for an online reservation directly using an online payment system, it is no longer possible to rebook or cancel the reservation online. The guest must contact the hotel directly in the event of a rebooking or cancellation request.

§ 4Arrival and departure
1.sHome Hotel Graz makes the hotel room available to the guest in the agreed room category or equipment on the day of arrival, usually from 2 p.m. The guest is not entitled to an earlier availability of the hotel room. For access to the hotel and the hotel room, the guest receives an access card at check-in at the check-in machine in the hotel or, in exceptional cases, at the reception.2.On the day of departure, the guest must vacate his hotel room by 10 a.m. at the latest and return it undamaged. Thereafter, sHome Hotel Graz can charge the guest 100% of the overnight price of the previous day for the use of the room beyond the contract due to the late vacating of the room. The guest is permitted to prove that sHome Hotel Graz did not suffer any damage or that the damage was significantly less. sHome Hotel Graz is free to prove higher damage.

§ 5Terms of Use
1.Only the persons identified in the reservation are authorized to use the hotel room. The maximum occupancy for the respective room category must not be exceeded. Children and babies count like adults.2.The resale, subletting or brokerage of booked rooms is prohibited unless otherwise expressly agreed in writing.3.The guest must observe the house rules posted there during his stay in the hotel.4.It is forbidden to consume tobacco products (especially cigarettes, cigars, pipes) and tobacco or smoke substitute products (especially e-cigarettes) in hotel rooms that are marked as non-smoking rooms. In the event of an infringement, sHome Hotel Graz is free to charge the guest for the (basic) cleaning costs for the consequences of the prohibited consumption or to charge a flat rate ("flat-rate compensation"). In the case of a flat rate, the guest is free to prove that the costs actually incurred are lower.

§ 6Accommodation prices and other prices
1.The overnight price to be paid by the guest is the consideration for the provision of the hotel room by sHome Hotel Graz within the arrival and departure times shown in § 4. A full overnight price is charged per overnight stay - regardless of the actual use or overnight stay by the guest - if applicable less saved expenses, unless otherwise regulated in § 3.2.The agreed prices or the prices of the sHome Hotel Graz price list valid at the time of the conclusion of the contract apply. sHome Hotel Graz has the right to increase or decrease the room rates if there are more than four months between the time of the reservation by the guest and the day of arrival. In the event of a price increase of more than 5%, the guest has the right to withdraw. This does not apply to increases in statutory taxes, fees and charges.3.The prices or amounts shown in these terms and conditions and in the reservation include the applicable sales tax as well as all statutory taxes, fees and charges, unless this is expressly stated otherwise.

§ 7Terms of payment
1.The overnight prices as well as the prices for ancillary services (such as breakfast and all other claims that are not expressly shown in the accommodation contract as part of the overnight stay price) are due for payment in advance at the latest upon arrival of the guest at the hotel, regardless of the date of the invoice. In the event of late payment, sHome Hotel Graz is entitled to terminate the accommodation contract, after which the guest must vacate the room.2.Without prejudice to Section 1, sHome Hotel Graz is entitled to request an advance payment of the accommodation costs up to the expected total invoice amount or an appropriate security in the form of a deposit by credit card from the guest when making the reservation.3.sHome Hotel Graz accepts cash in euros, bank transfers, EC and Maestro cards as well as the following credit cards: Visa, Mastercard, Dinersclub, JBC and Unionpay. Other means of payment are only permitted with the consent of sHome Hotel Graz.4.The guest can only assert rights of set-off and retention if the underlying counterclaims are undisputed or have been legally established.

§ 8.Special conditions for group travel
1.The following term "travel group" refers to a group of at least 15 full paying guests for whom a joint reservation exists. In deviation from or in addition to the above regulations, the following applies to a travel group:2.When making the reservation, a contact person ("overall responsible person") must be named for the travel group vis-à-vis sHome Hotel Graz.3.Before the travel group arrives, a list of names with all participants must be submitted to sHome Hotel Graz.4.When making a reservation, the person in charge of the entire sHome Hotel Graz will receive a reservation confirmation with the essential details of the reservation made, details of the check-in and, if applicable, of the security deposit and other payment conditions. Reservations by travel groups are always guaranteed reservations within the meaning of § 3.1. 5. The total amount of the accommodation costs is to be paid by bank transfer or credit card to the sHome Hotel Graz bank account specified in the reservation confirmation or the sHome Hotel Graz informs the person responsible after the reservation has been made. Fees for international transfers must be paid in full on arrival at the hotel at the latest.6.The accommodation costs of the travel group including costs for ancillary services within the meaning of § 7.1. are due for payment in advance, no later than 28 days before the day of arrival, or - if the reservation is made later than 28 days before the day of arrival - immediately, regardless of the date of the invoice. If no payment has been made by the due date, sHome Hotel Graz is entitled to rent out the hotel rooms reserved for the travel group (without prior notification to the person responsible), without the guest being able to assert any claims against sHome Hotel Graz.7.The travel group can cancel or change their reservation free of charge up to 28 days before the day of arrival. Later cancellations and changes are only possible with the consent of sHome Hotel Graz. In this case, the overnight rate is to be paid as the cancellation fee. The travel group is free to prove that the saved expenses of sHome Hotel Graz are higher.8.sHome Hotel Graz makes its hotel rooms available to the travel group on the day of arrival, usually from 2 p.m.9.sHome Hotel Graz is entitled, upon arrival of the tour group at the hotel (e.g. cash or by credit card), a security of up to € 500 per tour group, in particular for any ancillary services within the meaning of § 7.1. as well as to demand any damage from the person responsible.10.The travel group receives collective invoices from sHome Hotel Graz, which are handed over to the person responsible.

§ 9Special conditions for trade fair and event times
1.SHome Hotel Graz will inform the guest of trade fair and event times at any time upon request, at the latest when making a reservation. In deviation from or in addition to the above regulations, the following applies to trade fair and event times:2.Only guaranteed reservations are possible for overnight stays. Simple reservations, however, cannot be made.3.The guest can cancel or change his reservation free of charge up to a point in time before the day of arrival, which is based on the cancellation conditions resulting from the reservation confirmation. As part of the booking process, the guest is also shown the relevant cancellation deadline. Later cancellations and changes are only possible with the consent of sHome Hotel Graz. In this case, the overnight rate for the entire duration of the stay is to be paid as the cancellation fee. The guest is free to prove that the expenses saved by sHome Hotel Graz are higher.4.The accommodation costs including costs for ancillary services within the meaning of § 7.1. are due for payment in advance, but no later than the end of the day on which a free cancellation is possible for the last time before the day of arrival according to the preceding paragraph, or - if the reservation is made later - immediately for payment, regardless of the date of the invoice. If no payment has been made by the due date, sHome Hotel Graz is entitled to rent out the hotel room reserved for the guest (without informing the guest beforehand), without the guest being able to assert any claims against sHome Hotel Graz.

§ 10SHome Hotel Graz liability
1.sHome Hotel Graz is liable for damages for which it is responsible, resulting from injury to life, limb or health. Furthermore, sHome Hotel Graz is liable for other damages based on an intentional or grossly negligent breach of duty by sHome Hotel Graz or on an intentional or negligent breach of essential contractual obligations by sHome Hotel Graz. Essential contractual obligations are those that enable the proper execution of the contract and on the fulfillment of which the guest trusts and may trust. A breach of duty by sHome Hotel Graz is equivalent to that of a legal representative or vicarious agent. Further claims for damages are excluded, unless otherwise regulated in § 10.This liability regulation does not cover claims under data protection law.2.Should disruptions or deficiencies in the services of sHome Hotel Graz occur, the guest must immediately notify sHome Hotel Graz or the hotel staff on site. sHome Hotel Graz will endeavor to remedy the situation if it becomes aware of this or if the guest complains immediately. The guest is obliged to do what is reasonable for him to remedy the disruption and to keep possible damage to a minimum.3.sHome Hotel Graz is also liable to the guest for claims that the guest makes - for whatever legal reason - against sHome Hotel Graz, provided that this claim is caused by a culpable act or omission on the part of sHome Hotel Graz or its people or sHome Hotel Graz or theirs People has violated their duties of supervision with regard to third parties entering and leaving the hotel. This applies in particular to claims according to §§ 970 to 970c ABGB.4.If the guest is provided with a parking space in the hotel garage or on the hotel parking lot, even for a fee, this does not constitute a safekeeping agreement. In the event of loss of or damage to vehicles parked or maneuvered on the hotel property and their contents, sHome Hotel Graz is only liable in accordance with Section 10.1.5.Messages, mail and merchandise deliveries for guests are handled with care.

§ 11Theft and damage
In the event of theft or damage to their belongings, as well as in the event of fire, water damage or other damage to the hotel room, the guest must inform the hotel staff immediately and do everything that can reasonably be expected when investigating the theft or during the Eliminating the damage can be helpful.

§ 12Pets
Bringing dogs, cats and other animals (hereinafter referred to as "pets" even if they are not pets in the true sense of the word) is generally not permitted, but sHome Hotel Graz can approve it under certain conditions. In the event of consent, sHome Hotel Graz is nevertheless entitled to withdraw consent at any time without giving reasons.

§ 13Termination of the accommodation contract
1.sHome Hotel Graz is entitled to withdraw from the accommodation contract if the guest has not made an advance payment owed by him and / or a deposit owed by him on time or not in full.2.sHome Hotel Graz is entitled to terminate the accommodation contract in particular if the guest is under the influence of illegal drugs during his stay in the hotel, uses the hotel room for commercial activity with customer traffic, uses the hotel room for prostitution, hotel staff or others Hotel guests repeatedly insulted despite admonition or willful damage to house inventory and fixed installations.

§ 14privacy
1.The person responsible for the processing of personal data ("data processing") is the legal entity named in the context of the reservation. The guest can find further information in the data protection information available on the website and during the booking process. The recipient of the personal data is sHome Hotel Graz with whom the accommodation contract for the corresponding hotel room is concluded.A transfer of data to third parties only takes place within the framework of the legal requirements. We only pass this on if this is necessary for contractual purposes in accordance with Art. 6 Paragraph 1 lit. b) GDPR, we are obliged to do so due to legal requirements (Art. 6 Paragraph 1 lit. . Art. 6 para. 1 lit. f.) GDPR in the economic and effective operation of our business operations. These include service providers who, within the scope of data protection order processing in accordance with Art. 28 GDPR, are commissioned, among other things, for the technical operation of the booking systems or for the implementation of the accommodation contract in the hotel. We have taken suitable legal precautions as well as appropriate technical and organizational measures,to ensure the protection of personal data in accordance with the relevant legal regulations. The data processing takes place in the European Union. sHome Hotel Graz does not transmit any data to a third country (ie to a country outside the European Union (EU) or the European Economic Area (EEA)). § 15General provisions
1.Changes and additions to the accommodation contract, the acceptance of applications or these general terms and conditions must be made in writing. Unilateral changes or additions by the guest are ineffective.2.Any ineffectiveness of one or more of the above provisions does not affect the effectiveness of the remaining provisions.3.This agreement is subject to Austrian law to the exclusion of the conflict of laws rules and the provisions of the UN Convention on Contracts for the International Sale of Goods.4.The place of fulfillment and payment as well as the exclusive place of jurisdiction - also for check and bill of exchange disputes - is the seat of the hotel in business transactions or, at the option of sHome Hotel Graz, the court responsible for Graz in commercial matters. sHome Hotel Graz is also entitled to bring actions and other legal proceedings to the general place of jurisdiction of the guest. In the event of disputes arising from a consumer transaction, the legally prescribed place of jurisdiction applies.
